Deed from Elias Rockwell to James Parsons

This Indenture, made the twenty-second day of September in the year of our Lord one thousand eight hundred and forty-nine between Elias Rockwell of Canton Township Bradford Co State of Pennsylvania of the first part and James Parsons of the same place of the second part.

Witnesseth:-That the said party of the first part, for and in consideration of the sum of one hundred and fifty dollars, lawful money of the United States, to me in hand paid by the said party of the second part, at or before the ensealing and delivering hereof, the receipt whereof I do hereby acknowledge, and thereof acquit and forever discharge the said party of the second part, his heirs, executors, and administrators, by these presents have granted, bargained, sold, aliened, enfeoffed, released and confirmed, and by these presents do grant, bargain, sell, alien, enfeoff, release and confirm into the said party of the second part, and to his heirs and assigns, all that certain Lot, Piece or Parcel of Land, lying and being in the township of Canton Bradford County and State of Pennsylvania and bounded as follows, viz: Beginning at a post on the north line of Wm. S. Baker’s lot thence north eighteen perches to a post and stones thence east twelve perches to the center of the road leading from Canton to Troy, thence N 17° W twelve perches and twenty links along the center of said road to the south west corner of Conklin’s lot thence South 88° & along Conklin’s line sixteen perches and sixteen links to a butternut tree being the South East corner of Conklin’s lot thence 80° (?) & four perches and seven links to a post thence N 70° & thirteen perches to a post thence North with the proper(?) variation fifty four perches to a post on Goodwin Fuller’s South line thence East with the variation Ninety four perches to a post on the West line of Josiah Loomis’es land thence South with the variation Eighty nine perches to a post being the North East corner of land formerly owned by John Grantier thence West with the variation one hundred and thirty six perches to the place of beginning containing fifty-eight and a half acres more or lefs it being a part of a lot of land deeded from David Cash to Elias Rockwell which was deeded from A. McCall to David Cash and from the State of Pennsylvania to A. McCall.

TOGETHER WITH ALL AND SINGULAR, the rights, liberties, privileges, hereditaments and appurtenances, whatsoever thereunto belonging, or in any wise appertaining, and the reversions and remainders, rents, issues, and profits thereof. And also, all the estate, right, title, interest, claim and demand whatsoever, of the said part I of the first part, in law or equity of, in, to, or out of the same. TO HAVE AND TO HOLD, the said hereditaments and premises, hereby granted or mentioned or intended so to be, with the appurtenances, unto the said party of the second part, his heirs and assigns, to the only proper use and behoof of the said party of the second part his heirs and assigns, forever. And the said party of the first part, do for himself and his heirs, executors, and administrators, promise and agree, to and with the said party of the second part, his heirs and assigns, that the above described promised, with the appurtenances, unto the said party of the second part, his heirs and assigns, WILL WARRANT AND FORVER DEFEND, against all or any person or persons. Lawfully claiming and to claim the same from by or under me or my heirs.

Be it remembered, that on the tenth day of May A. D., 1851, personally appeared before the subscriber, one of the Justices of the Peace, in and for said county,

Elias Rockwell and Mary Rockwell, his wife, the above grantors, and acknowledged the foregoing indenture to be their act and deed, for the purposes therein contained. She the said, Mary Rockwell being of full age, and by me examined separately and apart from her husband, acknowledged that she executed the same of her own free will and accord, without any coercion or compulsion on the part of her husband.

Witness my hand and seal, the day and year aforesaid.

N.B. – According to Roger Keagle (the 2nd great-grandson of James Parson) a part of this parcel was sold to the Park Cemetery Association about 1911.
