Henry Haverly A.D.M.  to Henry Sherman, Jr.

To all persons to whom these presents shall come I James Haverly of Overton Township Bradford County and State of Pennsylvania. Administrator of all and singular the goods and chattels rights and credits which were of Henry Haverly the said late of Overton Township aforesaid deceased send greetings. Whereas the said Henry Haverly 2nd in his lifetime to --?-- the 14th day of October AD 1862 entered into a written contract by articles of agreement to sell and convey unto the said Henry Sherman junior his heirs and assigns a certain parcel of land situated in Overton Township aforesaid bounded and described as follows to wit Beginning at a hemlock corner South 32 1/2 to one hundred and one perches to a hemlock corner thence S 68 degrees North East 22 7/10ths perches to chestnut sapling corner thence S 71 degrees 8. 59 1/2 perches to post thence S 32 1/2 degrees W 87 perches to post thence N 68 1/2 degrees W 80 and 2/10ths perches to place of beginning containing fifty acres for the consideration of two hundred dollars which amount has been fully paid by the said Henry Sherman to the said administrator of Henry Haverly deceased and whereas the same James Haverly administrator as aforesaid filed his petition in the Orphan’s Court of Bradford County setting forth said facts and that the said Henry Haverly had died without executing and delivering a deed to the said Henry Sherman as he had covenanted to do and that the judges of the Orphan Court aforesaid after due consideration decreed a specific performance of said contract and made the order deserving that the said James Haverly Administrators as aforesaid executed a good and efficient deed to the said Henry Sherman junior his heirs and assigns of the land aforesaid all of which will more fully appear from the records and proceedings of said court reference thereto being had now know ye that by virtue of the authority and --?--and decree aforesaid and in order to forfeit and perform all things in the above mentioned contract agreement on the part of the said Henry Haverly deed remaining to be performed and in consideration of two hundred dollars to me in hand paid by the said Henry Sherman the receipt whereof is hereby acknowledged and in consideration that the said Henry Sherman junior hath performed and fulfilled all things in the above recited contract or agreement on his part to the done and performed I the said James Haverly administrator as the aforesaid have granted bargained sold conveyed released and confirmed and by these presents do hereby grant bargain sell convey release and confirm unto the said Henry Sherman junior his heirs and assigns forever the land and premises herein described with all the privileges and appertanences thereto belonging to have and to hold the land and premises aforesaid with the privileges and appertanences until the said Henry Sherman junior his heirs and assigns forever to his and their proper use in witness whereof I have hereunto set my hand and affirmed my seal to this thirteenth day of December AD one thousand eight hundred and sixty four.
